What To Do When Your Claim Is Rejected
Unfortunately there are times when you might have a dispute with your insurance company, and in recent times we have seen a lot of this coming into the news of late. Here are some ideas and solutions for you to consider if you have had your insurance claim, for either your car, home and contents insurance knocked back.
Seek an explanation. If your claim has been refused it is a good idea to have that explained to you. It may be that you have not understood your insurance policy properly. Legal definitions and the meanings of words can often be different. You should seek a full explanation and a statement why the claim has been refused in writing. A claim being knocked back must be in writing to be valid, and what is in writing will have great impact in the future. Do not just accept that you claim has been rejected without getting a full explanation of that in writing.
Internal dispute resolution. Any good insurance company will have a function internally for disputing any decision, and it is good practise for the company to be doing so. Before you think about other actions outside of the company it is due diligence to take up the matter inside the company that you are being insured by.
Get legal advice. There are many ways to seek legal advice, as you may wish to dispute the grounds of why your claim is not being paid, and this is why you MUST get the claim refusal fully explained in writing. Legal advice from a lawyer who knows you and knows a particular area of law, such as home insurance, will give you a good understanding very fast. A good lawyer will be able to tell you if you are in the right or wrong, and could be saving you a lot of time and money. In larger cases, going to court may be the only option.
Ombudsman. Your Ombudsman is their to take up complaints from you if you feel that you have been treated unfairly. This is where you can get considerable advice, and can start a chain of events that might make your insurance company change its mind. The current government is paying a lot of attention to the current situation and you can expect to get heard. Costs are little or nothing.
Tribunal. The appropriate tribunal for consumer claims in your state will help you to bring a judgement on your situation on smaller claims with a minimum of waiting and cost.
Use media to your advantage. With the social media taking over the world radically in the last few years, it has given a lot of power to most of it. Media is there to give you a voice in democracy, look at what actions you can take but be careful not to be liable and make a fool of yourself.
Change your insurer. The whole point of being insured is to have a sense of security and to have your claims covered. If you are in a situation where your insurance company is not paying you based on a technicality or some fine print, it is a good idea to change immediately. If they have done it once to you, they will probably do it again. More modern companies are removing ridiculous legal jargon and fine print from their contracts, and it is interesting to note these are all matters that are under current scrutiny by the Australian Government now.
